AGREEMENT <br />FOR PROFESSIONAL SERVICES <br />[BKF ENGINEERS] <br /> <br /> THIS AGREEMENT, made and entered into this -I' day of <br />~,f(~ , 2003, by and between the CITY OF REDWOOD CITY, a charter <br /> <br />city and municipal corporation of the State of California ("City"), and BKF ENGINEERS <br />("Consultant") (collectively, the "Parties"). <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, City proposes to construct the 5th Avenue Storm Drainage Pump <br />Station in the City of Redwood City (the "Project"); and <br /> <br /> WHEREAS, in connection with the Project, the City requires professional <br />engineering and design services; and <br /> <br /> WHEREAS, Consultant represents that it possesses the experience, and is <br />qualified to perform the aforesaid services for the Project. <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. CONSULTANT'S SERVICES. Consultant shall perform the final design for <br />the 5th Avenue Storm Drainage Pump Station, and related services described in Exhibit <br />"A" hereof, attached hereto and by this reference incorporated herein. <br /> <br /> 2. COMPENSATION; EXPENSES; PAYMENT. City shall compensate <br />Consultant for all services performed by Consultant hereunder in an amount based <br />upon Consultant's hourly rates that are prevailing during the time of the performance of <br />said services. A copy of Consultant's hourly rates for which services hereunder shall be <br />performed are set forth in Consultant's fee schedule marked Exhibit "B" hereof, <br />attached hereto and by this reference incorporated herein. <br /> <br />F:Affy/Agr/Agr.098 1 <br />012303 <br /> <br /> <br />
