AGREEMENT <br /> <br /> PROFESSIONAL CONSULTING SERVICES <br /> Redwood City Recycled Water Project <br /> Community Learning and Outreach <br /> Data Instincts <br /> <br /> THIS AGREEMENT, made and entered into this <br /> __ day of r-~'[ , <br /> <br />2003, by and between the CITY OF REDWOOD CITY, a charter city and municipal <br />corporation of the State of California ("City"), and DATA INSTINCTS of Windsor, <br />California ("Consultant") (collectively, the "Parties"). <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, City proposes to implement a water recycling project in the City of <br />Redwood City (the "Project"); and <br /> <br /> WHEREAS, in connection with the Project, the City requires professional <br />consulting services; and <br /> <br /> WHEREAS, Consultant represents that it possesses the experience, and is <br />qualified to perform the aforesaid services for the Project. <br /> <br /> NOW, THEREFORE, the Parties hereto agree as follows: <br /> <br /> 1. CONSULTANT'S SERVICES. Consultant shall only perform consulting <br />services described as Phase One in Exhibit "A" hereof, attached hereto and by this <br />reference incorporated herein. <br /> <br /> 2. COMPENSATION; EXPENSES; PAYMENT.
