O R I G I N A L <br />RESOLUTION NO. 14377 <br />09/10/01 <br />RESOLUTION DECLARING THAT THE PUBLIC INTEREST OR NECESSITY <br />DEMANDS THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY <br />PURSUANT TO THE PROVISIONS OF SECTION 68 OF THE CHARTER OF <br />THE CITY OF REDWOOD CITY AND SECTION 20168 OF THE PUBLIC <br />CONTRACT CODE OF THE STATE OF CALIFORNIA WITHOUT <br />ADVERTISING FOR BIDS FOR THE CONSTRUCTION OF CERTAIN <br />REPLACEMENT PUBLIC ACCESS FACILITIES HEREIN DESCRIBED, <br />APPROVING CHANGE ORDER TO CONTRACT DOCUMENTS, AND <br />AUTHORIZING EXECUTION OF THE CHANGE ORDER FOR SUCH WORK <br />(Waring Construction, Inc.) <br />WHEREAS, the City of Redwood City is a co- permittee to Permit No. 6- <br />94, as amended, (the "Permit'), issued by the San Francisco Bay Conservation <br />and Development Commission ( "BCDC ") related to the repair, rehabilitation, and <br />reconstruction of levees in the Redwood Shores Area of the City; and <br />WHEREAS, pursuant to the Permit, certain improvements providing <br />public access to the San Francisco Bay wetlands including, without limitation, <br />public trail and observation platforms (the "Replacement Improvements "), were <br />to have been constructed on or before September 1, 1999; and <br />WHEREAS, the Replacement Improvements replace a portion of existing <br />public access no longer available for such use as a result of regulatory permit <br />requirements of the United States Fish and Wildlife Service and the United <br />States Army Corps of Engineers; and <br />WHEREAS, as a consequence of alleged noncompliance with various <br />conditions of the Permit, BCDC commenced formal enforcement proceedings <br />against the co- permittees, including the City of Redwood City; and <br />- 1 - <br />R W C /Comdev <br />RES00829 <br />98/29/01 <br />
