08/22/2011 <br /> ORIGINAL <br /> RESOLUTION N0.15139 <br /> A RESOLUTION OF THE CITY OF REDWOOD CITY APPROVING <br /> MINOR REVISIONS TO THE FRANCHISE AGREEMENT WITH <br /> RECOLOGY SAN MATEO COUNTY AND AUTHORIZING THE CITY <br /> COUNCIL UTILITIES SUBCOMMITTEE TO APPROVE WAIVERS OF <br /> CERTAIN MINOR OR TEMPORARY PROVISIONS IN THE FRANCHISE <br /> AGREEMENT <br /> WHEREAS, the City of Redwood City (City) entered into a Franchise Agreement <br /> with Recology San Mateo County ("Recology") on May 25, 2010; and <br /> WHEREAS, the Franchise Agreement covers a ten (10) year period for <br /> recyclable, organic and solid waste materials collection services; and <br /> WHEREAS, from time to time minor waivers or temporary waivers of certain <br /> provisions of the Agreement may be necessary to allow for temporary or unforeseeable <br /> circumstances; and <br /> WHEREAS, Recology has requested a waiver of Article 8.04 of the Agreement <br /> which would allow it to employ used collection vehicles for a period of not to exceed six <br /> months; and <br /> WHEREAS, the request stems from the necessity for Recology to assign <br /> additional collection vehicles on various routes which have heavier collection activity <br /> than anticipated; and <br /> WHEREAS, in the future the City may be asked to evaluate additional minor or <br /> temporary waivers of provisions of the Agreement which address unanticipated <br /> circumstances but do not amend the Agreement or affect core service levels to <br /> Redwood City solid waste collection service customers; and <br /> ATTY/RES0.2152/RECOLOGY RESO. # 15139 <br /> 080511 1 MUFF # 801 <br />
