FXS: dft 14/95 (043/38) <br /> .... 14/95R <br /> <br /> 0 R I G I N A L 3/13/95 <br /> RESOLUTION NO. 12432 <br /> <br /> RESOLUTION OF NECESSITY OF THE CITY OF REDWOOD CITY <br /> INITIATING EMINENT DOMAIN PROCEEDINGS FOR THE <br /> ACQUISITION OF THE PROPERTY LOCATED AT 1007 JEFFERSON <br /> AVENUE (aka 1001 Jefferson Avenue) <br /> <br /> WHEREAS, it is necessary and desirable for the City of <br />Redwood City ("City") to acquire title in fee simply to that <br />certain real property (hereinafter "Property") known as 1007 <br />Jefferson Avenue (aka 1001 Jefferson Avenue) more particularly <br />described in Exhibit "A", attached hereto and by this reference <br />made a part hereof; and <br /> <br /> WHEREAS, the public use for which the Property is to be <br />taken is the construction by the City of Redwood City and use by <br />the public of a vehicular and pedestrian underpass and incidental <br />use (the "Project"); and <br /> <br /> WHEREAS, the City is authorized to acquire real property by <br />eminent domain pursuant to Section 37350.5 of the Government <br />Code; and <br /> <br /> WHEREAS, notice has been given as required by Section <br />1245.235 of the Code of Civil Procedure, and a hearing was <br />regularly held by the City Council on the 13th day of March, <br />1995, at which all persons shown as having an interest in the <br />Property on the last equalized county assessment roll were given <br />a reasonable opportunity to appear and be heard on the matter set <br />forth hereinafter; <br /> <br /> NOW, THEREFORE, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS <br />FOLLOWS: <br /> <br /> <br />
