09/24/2012 <br /> ORIGINAL <br /> ORDINANCE NO. 2385 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY AMENDING SECTION 10.6 OF CHAPTER 10 <br /> OF THE REDWOOD CITY MUNICIPAL CODE RELATING TO <br /> DIRECTOR AUTHORITY DURING EMERGENCIES <br /> WHEREAS, the City adopted an Emergency Operations Plan in May, 2006 and <br /> updated that Plan on April 15, 2009; and <br /> WHEREAS, Said Emergency Operations Plan names the City Manager as the <br /> Emergency Operations Director; and <br /> WHEREAS, Section 10.5 of the City of Redwood City Municipal Code also <br /> names the City Manager as the Emergency Operations Director; and <br /> WHEREAS, the City Manager is responsible for the day to day operations of the <br /> City and has the expertise and, as Emergency Operations Director, the responsibility, to <br /> manage the City during emergencies; and <br /> WHEREAS, Section 14 of the City's Charter provides that in case of riot, <br /> insurrection, or extraordinary emergency, the Mayor shall assume general control of the <br /> city government and all of its branches and shall be responsible for the suppression of <br /> disorders and the restoration of normal conditions; and <br /> WHEREAS, the Mayor desires to exercise his authority to assume general <br /> control during an emergency by delegating and assigning to the City Manager as the <br /> Emergency Operations Director, the responsibility to manage the City during <br /> emergencies and to direct the City's response to an emergency; and <br /> WHEREAS, the Mayor and City Council desire to clarify that the City Manager as <br /> the Emergency Operations Director has the authority to manage the City during <br /> emergencies and to direct the City's response to emergency. <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. Section 10.6 of the Redwood City Municipal Code is hereby <br /> amended to read as follows: <br /> Sec.10.6. - EMERGENCY POWERS, DUTIES: <br /> A. Upon determining that conditions which constitute a local emergency exist, <br /> the Council or, if a quorum of the Council is unable to convene, the City <br /> Manager as Emergency Services Director may proclaim the existence of a <br /> ATTY/ORD.375/AMEND.SECT.10.6 OF CHAP.10 AUTHORITES DURING EMERGENCIES ORD.#2385 <br /> REV:07-16-12 JS FORMERLY MUFF#305 <br /> Page 1 of 4 <br />
