0~%~1~~ CGM:jp 6/11/79 <br /> CGM:jp 7/12/79 R <br /> 7/13/79 a <br /> <br /> AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this <br /> <br />day of ~ , 1979, by and between the CITY OF <br /> <br />REDWOOD CITY, a municipal corporation, hereinafter referred to as <br />"City", and SAN MATEO COUNTY SCAVENGER COMPANY, a subsidiary <br />of Browning-Ferris Industries, a corporation, hereinafter re- <br />ferred to as "Company"; <br /> <br /> WI TNE S S E TH : <br /> <br /> WHEREAS, City and Company wish to enter into an agreement <br /> <br />by which Company is granted the exclusive contract right, license, <br />and privilege to collect and dispose of all garbage, rubbish and <br />waste matter accumulated within City; <br /> <br /> NOW, THEREFORE, it is hereby agreed as follows: <br /> <br /> 1. Term. City grants to Company the exclusive license, <br />contract, right and privilege to collect and dispose of all <br />garbage, rubbish and waste matter, as herein defined, accumulated <br />in City, for a period of ten (10) years, commencing July 1, 1979, <br />and ending at midnight June 30, 1989, excepting as hereinafter <br />provided. By mutual agreement, the parties may renew this <br />agreement for an additional five (5) year period and for succes- <br />sive one (1) year periods thereafter; provided, however that <br />this agreement may be terminated without cause by either party <br />during any such one year renewal upon written notice given to <br />the other party not less than six (6) months prior to the <br />effective date of such termination. <br /> <br /> 2. Garbage Defined. The word "garbage" shall for the <br />purposes of this agreement include all matter defined as gar- <br />bage, rubbish, waste matter, or refuse in Section 14.1 of the <br />Redwood City Code, as amended, or any successor thereof; provided, <br />however, that dirt, rock, wood plaster, and brick waste, are <br />hereby excluded from the definition of garbage. <br /> <br /> <br />
