ORIGIN�.� <br /> MEMORANDUM OF UNDERSTANDING BETWEEN <br /> CITY OF REDWOOD CITY AND REDWOOD CITY SCHOOL DISTRICT <br /> This MEMORANDUM OF U�IDERSTANDING ("MOU") is made and entered into <br /> as of the �7 day of � �( 201�, by and between REDWOOD <br /> CITY SCHOOL DISTRICT ("DistricY') and Y OF REDWOOD CITY, a charter city and <br /> municipal corporation of the State of California ("City"). Collectively, District and City <br /> are hereinafter referred to as the "Parties." <br /> SUBJECT: DistricYs $200,000 financial contribution toward replacement of the <br /> synthetic turf field at the DistricYs Fair Oaks Elementary School site. <br /> RECITALS <br /> WHEREAS, the District is the owner of certain real property, also known as Fair <br /> Oaks Elementary School, located at 2950 Fair Oaks Avenue, Unincorporated Redwood <br /> City ("Property"); and <br /> WHEREAS, the District and City have determined that the synthetic turf playfield <br /> ("Playfield") located on the Property has a joint benefit for all Parties because th� <br /> Playfield is maintained and used for school activities during school hours and for <br /> community-wide recreational use during off-school hours; and <br /> WHEREAS, the Parties desire to cooperate to fund the replacement of the <br /> Playfield ("Project") and have it maintained after replacement for use by the District and <br /> City; and <br /> WHEREAS, the Project is estimated to cost $575,000 to complete, including <br /> architectural services and contingencies; and <br /> WHEREAS, a total of $575,000 has been committed to the Project as follows: <br /> the Redwood City Council approved $300,000 for the Project; the City obtained a San <br /> Mateo County Community Development Block Grant (CDBG) of$75,000 for the Project; <br /> and the District approved $200,000 for the Project from its capital improvement budget; <br /> and <br /> WHEREAS, the City's financial contribution toward the Project does not <br /> constitute a gift of public funds due to the substantial benefit the City will receive <br /> through community-wide recreational use of the Playfield pursuant to the Joint Use of <br /> Facilities Agreement executed by the District and City on November 14, 2012; and <br /> WHEREAS, the Parties desire to enter into this MOU for the purposes of <br /> memorializing the District's $200,000 financial contribution toward the Project, and the <br /> roles and responsibilities of the Parties regarding the Project and Playfield. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> ATTY/AGR.2013.008JMOU SCHOOL DISTRICT AND RC FOR CONTRIBUTION FOR TURF FIELD REPLACEMENT <br /> REV:01-11-13 MLG <br /> Page 7 of 4 <br />
