o�eGi���. <br /> REVOCABLE LICENSE AGREEMENT <br /> BETWEEN THE CITY OF REDWOOD CITY AND <br /> BAY AREA AIR QUALITY MANAGEMENT DISTRICT <br /> THIS REVO B E LICENSE AGREEMENT ("Agreement") is made and <br /> entered into as of � �71 O( ("Effective Date"), by and between the CITY OF <br /> REDWOOD CITY (hereinafter "City"), a California Charter City and municipal <br /> corporation, and the Bay Area Air Quality Management District (hereinafter "Licensee") <br /> whose address is 939 Ellis Street, San Francisco, CA 94109. <br /> RECITALS <br /> A. Licensee is the local governmental agency with primary responsibility for <br /> regulating stationary source air pollution in the Bay Area Air Quality Management <br /> District in the State of California. Licensee is authorized to enter into this Agreement <br /> under California Health and Safety Code Section 40701. <br /> B. Licensee desires to temporarily install and operate air quality monitoring <br /> equipment (Partisol-Plus Model 2025 Sequential Air Sampler) on property owned and <br /> maintained by City. The City property (Pump House Building) is located near 1050 Twin <br /> Dolphin Drive in Redwood City, California, 94065. <br /> C. City desires to grant to Licensee a revocable license to oper�te equipment at <br /> the site on the terms and conditions contained in this agreement, provided that the <br /> public health, safety and welfare are not thereby impinged, diminished or adversely <br /> affected. <br /> D. All parties to this agreement have had the opportunity to have this agreement <br /> reviewed by their attorney. <br /> NOW, THEREFORE, in consideration of the recitals and mutual obligations <br /> contained herein, City and Licensee agree as follows: <br /> 1. Nature of Aqreement. The nature of the right granted by City to Licensee is <br /> that of a revocable license and not a permit nor a lease. No property right is granted <br /> hereby. Notwithstanding the foregoing, Licensee hereby knowingly waives and relin- <br /> quishes any rights it may have or claim to have pursuant to California Government <br /> Code Sections 7260 through 7277. <br /> 2. License Area. The real property permitted to be used under this Agreement <br /> is a portion ("the Site") of that certain City property (the single story flat roof on the City's <br /> Pump House building next to the Water Tank) located near 1050 Twin Dolphin Drive, <br /> Redwood City, California 94065 ("City Property").
