FUNDING AGREEMENT SAN MATEO COUNTY NEW MEASURE A FUNDS HUDSON STREET BICYCLE AND PEDESTRIAN IMPROVEMENTS PROJECT This FIJNDING AGREEMENT ("Agreement") is made this�day of h� , 201�by and between the SAN MATEO COLINTY TRANSPORTATION AUTHO T ("TA") and the CITY OF REDWOOD CITY ("SPONSOR"),together referred to herein as the "Parties." RECITALS WHEREAS, on November 2, 2004, the voters of San Mateo County approved the continuation of the collection and distribution by the TA of the Measure A 1/2 cent transaction and use tax for an additional 25 years to implement the 2004 Transportation Expenditure Plan, beginning January 1, 2009 ("New Measure A"); and WHEREAS, the CITY OF REDWOOD CITY submitted an application requesting $532,640 in New Measure A funds for the preliminary engineering, final design and construction of the Hudson Street Bicycle and Pedestrian Improvements ("Project"); and WHEREAS,Hudson Street Bicycle and Pedestrian Improvements project meets the intent of the 2004 Transportation Expenditure Plan and the TA's 2009-2013 Strategic Plan; and WHEREAS, on July 7, 2011, the TA's Board of Directors programmed and allocated up to $532,640 from the New Measure A Pedestrian and Bicycle Program for the preliminary engineering, final design and construction phases of the Project through Resolution 2011-1 l; and WHEREAS, the TA and SPONSOR desire to adopt this Agreement to establish the process, terms and conditions governing the allocation and expenditure of New Measure A funds on the Proj ect. Now therefore, the Parties agree as follows: SECTION 1: Project Oversight and Reporting 1.1 SPONSOR Oversi�ht; Work Plan. SPONSOR shall be the lead agency responsible for the completion of the Project. SPONSOR shall assume responsibility for advertising, bidding, awarding and administering any professional service and/or other contracts entered into in connection with the Project. SPONSOR shall oversee completion of the Project as described in Exhibit A, "Project Information," which is attached to this Agreement and incorporated herein by this reference. Though SPONSOR may appoint a designee or engage contractar(s) to perform work necessary for Project completion, SPONSOR will remain ultimately responsible to the TA for performance of all responsibilities set forth herein.
