AGREEMENT <br /> Bay Area Paving Co. Inc. <br /> THIS A REEMENT is made and entered into as of the day of <br /> , 2013, by and between the City of Red ood City, a <br /> charter city and m icipal corporation of the State of California ("City"), and BAY <br /> AREA PAVING C . INC. ("Contractor") <br /> RECITALS <br /> A. City requires Contractor's services. <br /> B. Contractor has the necessary experience in providing professional services <br /> and advice. <br /> C. Selection of Contractor is expected to achieve the desired results in an <br /> expedited fashion. <br /> D. Contractor has submitted a proposal to City and has affirmed its willingness <br /> and ability to perForm such work. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual <br /> covenants contained herein, the Parties agree as follows: <br /> 1. Scope of Work and Time for Performance. Contractor shall perform <br /> everything required to be perFormed, shall provide and furnish all of the <br /> labor, equipment, materials, and tools to perform, within ten (10) calendar <br /> days after the NOTICE TO PROCEED, the following work: <br /> 2013 Spot Reconstruction Project <br /> (Eaton Avenue, Eaton Villa Place, Maple Street, and Vera Avenue) <br /> in strict accordance with the Plans, Contract Documents and <br /> Specifications pertaining thereto as described in Exhibit "A", attached <br /> hereto and incorporated herein, signed by the Manager, Engineering and <br /> Construction of Redwood City, which Documents are incorporated herein <br /> and made a part of this Agreement as if herein fully set forth. <br /> 2. Compensation. City shall pay to Contractor, as full consideration for the <br /> faithful perFormance by Contractor of the aforementioned work, the <br /> amount of Twenty Four Thousand Three Hundred Sixty and 00/100 <br /> ($24,360.00) computed in accordance with Contractor's accepted <br /> Proposal dated April 25, 2013 which accepted Proposal is incorporated <br /> herein by reference thereto as if herein fully set forth. <br /> 1 <br />
