DES:yc:4/15/77 <br /> JOINT EXERCISE OF POWERS AGREEMENT <br /> SOUTH BAYSIDESYSTEM AUTHORITY <br /> Supplemental Agreement I <br /> <br /> THIS AGREEMENT, dated for convenience as of JUNE 8 , <br /> 1977, by and between the CITY OF BELMONT ("Belmont"), a general <br /> law City, the CITY OF REDWOOD CITY ("Redwood City"), a chartered <br /> City, the CITY OF SAN CARLOS ("San Carlos"), a general law City, <br /> and MENLO PARK SANITARY DISTRICT ("Menlo"), a sanitary district, <br /> each duly organized and existing in the County of San Mateo, <br /> State of California, under the Constitution and laws of the State <br /> and collectively called the "Agencies"; <br /> WIT N E.S SET H : <br /> WHEREAS, the agencies have heretofore entered into an agreement <br /> dated November 13, 1975, entitled "Joint Exercise of Powers Agreement <br /> - South Bayside System Authority (" the Agreement"); and <br /> WHEREAS, the Agreement establishes the South Bayside SysteM <br /> Authority to finance, acquire and construct, and to manage, operate <br /> and maintain the Joint Facilities (as defined in the Agreement) <br /> for sanitary sewerage transmission, treatmerlt and disposal services <br /> .. <br /> for the Agencies; and <br /> WHEREAS, Section 7.2 of the Agreement establishes maximum <br /> capacity rights in the Joint Facilities of the respective Agencies <br /> estimated as of the time of entering into the Ag~eement; and <br /> WHEREAS, the aforesaid estimated capacity rights do not take <br /> into consideration changes in the design of Stage 1 of the Project <br /> (defined in the Agreement) reflective of current information and <br /> requirements of the Agencies; and <br /> WHEREAS, Section 9.5 of tho Agreement provides that the <br /> 1005176 <br />
