RESOLUTION NO. 13-30 <br /> A RESOLUTION OF THE PLANNING COMMISSION OF THE <br /> CITY OF REDWOOD CITY DENYING A USE PERMIT FOR THE <br /> CAMBRIDGE ACADEMY PROJECT PURSUANT TO THE CITY <br /> OF REDWOOD CITY ZONING ORDINANCE <br /> WHEREAS, Carol and Nicholas Berg ("Applicants") have applied for <br /> approval of a Use Permit to operate a transitional kindergarten through 8th grade <br /> private school with up to 180 students and 20 employees at the Redwood Baptist <br /> Church property, located at 2323-2325 Euclid Avenue ("Project"); and <br /> WHEREAS, the Planning Commission of the City of Redwood City <br /> ("Commission") is empowered by Article 42 (Use Permits) of the City of Redwood <br /> City Zoning Ordinance to act upon applications for use permits; and <br /> WHEREAS, on December 10, 2013, the Commission conducted a duly <br /> noticed public hearing, in accordance with all applicable requirements of the <br /> California Environmental Quality Act ("CEQA"), the State Planning and Zoning <br /> Law and the Redwood City Zoning Ordinance, to consider certification of the <br /> Final Environmental Impact Report for the Project, State Clearinghouse No. <br /> 2013012016 ("Final EIR"), approval of Use Permit Application No. UP2012-18, <br /> and received and considered oral and documentary evidence on the application; <br /> and <br /> WHEREAS, on December 10, 2013, the Commission considered and <br /> certified Final lEIR prepared by the City's Planning Services in accordance with <br /> the requirements of CEQA in compliance with all CEQA requirements as part of <br /> the City's consideration of Use Permit Application No. UP2012-18; and <br /> WHEREAS, the Commission has determined that denial of Use Permit <br /> Application No. UP2012-18 would further the purposes of and appropriately <br /> implement the City of Redwood City General Plan and applicable provisions of <br /> the Redwood City Municipal Code and Zoning Ordinance. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING <br /> COMMISSION OF THE CITY OF REDWOOD CITY, AS FOLLOWS: <br /> Section 1. The Planning Commission finds that the above recitals are <br /> accurate and constitute findings in this matter and, together with the Staff Report <br /> and the application materials, including without limitation the Final EIR, <br /> development plan, and all other documents, reports, studies, memoranda, maps, <br /> oral and written testimony, and materials in the City's file for the application and <br /> the Project, and all adopted City planning documents relating to the Project and <br /> the property including the City's General Plan, Municipal Code, Zoning <br /> Ordinance, and other applicable City laws and regulations, and all associated <br /> ATTY/RES0.2931/PC RESO APPROVING USE PERMIT CAMBRIDGE ACADEMY <br /> REV:01-10-14 JS <br /> Page 1 of 3 <br />
