RESOLUTION NO. 13-30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF REDWOOD CITY DENYING A USE PERMIT FOR THE CAMBRIDGE ACADEMY PROJECT PURSUANT TO THE CITY OF REDWOOD CITY ZONING ORDINANCE WHEREAS, Carol and Nicholas Berg ("Applicants") have applied for approval of a Use Permit to operate a transitional kindergarten through 8th grade private school with up to 180 students and 20 employees at the Redwood Baptist Church property, located at 2323-2325 Euclid Avenue ("Project"); and WHEREAS, the Planning Commission of the City of Redwood City ("Commission") is empowered by Article 42 (Use Permits) of the City of Redwood City Zoning Ordinance to act upon applications for use permits; and WHEREAS, on December 10, 2013, the Commission conducted a duly noticed public hearing, in accordance with all applicable requirements of the California Environmental Quality Act ("CEQA"), the State Planning and Zoning Law and the Redwood City Zoning Ordinance, to consider certification of the Final Environmental Impact Report for the Project, State Clearinghouse No. 2013012016 ("Final EIR"), approval of Use Permit Application No. UP2012-18, and received and considered oral and documentary evidence on the application; and WHEREAS, on December 10, 2013, the Commission considered and certified Final lEIR prepared by the City's Planning Services in accordance with the requirements of CEQA in compliance with all CEQA requirements as part of the City's consideration of Use Permit Application No. UP2012-18; and WHEREAS, the Commission has determined that denial of Use Permit Application No. UP2012-18 would further the purposes of and appropriately implement the City of Redwood City General Plan and applicable provisions of the Redwood City Municipal Code and Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF REDWOOD CITY, AS FOLLOWS: Section 1. The Planning Commission finds that the above recitals are accurate and constitute findings in this matter and, together with the Staff Report and the application materials, including without limitation the Final EIR, development plan, and all other documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the City's file for the application and the Project, and all adopted City planning documents relating to the Project and the property including the City's General Plan, Municipal Code, Zoning Ordinance, and other applicable City laws and regulations, and all associated ATTY/RES0.2931/PC RESO APPROVING USE PERMIT CAMBRIDGE ACADEMY REV:01-10-14 JS Page 1 of 3
