<br /> IMPROVEMENT AGREEMENT
<br /> One Marina—Bair Island Road Phase 2
<br /> IS IMPRO EMENT AGREEMENT ("Agreement") is made and entered into on this�day
<br /> of ,20)�("Effective Date")by and between by and between RC Peninsula Park, �
<br /> LLC, a Delaware 1' ited liability partner("Developer"), and the CITY OF REDWOOD CITY, a �
<br /> charter city and C lifornia municipal corporation("City") with reference to the following facts:
<br /> RECITALS
<br /> A. Developer is the current fee owner of that certain real properiy consisting of
<br /> approximately 33.24 acres located within the City of Redwood City, County of San Mateo, State of
<br /> California,described in Exhibit A,attached hereto and incorporated herein by reference(the"Property").
<br /> B. On July 20, 2010, the Planning Commission of the City of Redwood City approved,
<br /> among other approvals, the Vesting Tentative Map for One Marina ("Project"), prepared by KPFF
<br /> Consulting Engineers and dated July 15, 2010 ("Tentative Map"), subject to certain conditions of
<br /> approval("Conditions").
<br /> C. The Conditions require either (1) that certain public improvements for the Project be
<br /> constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an
<br /> agreement with City providing for the future construction of such public improvements.
<br /> D. Developer has submitted the Final Map and applied to City for Final Map approval
<br /> without having completed the required public improvements and, therefore, will enter into an agreement
<br /> with City providing for the future construction and installation of such public improvements, as required
<br /> by Government Code section 66462(a)(1).
<br /> E. Developer has submitted to City plans, specifications and drawings entitled air sl d
<br /> Road Phase 2 Improvement Plans, prepared by KPFF Consulting Engineers and dated ,
<br /> 20_ (the "Improvement Plans"), which, in addition to other improvements, provide for ce ain n-site
<br /> public improvements consisting of street and street light improvements, storm drain systems, domestic
<br /> water systems and sanitary sewer systems for the Project(collectively, "Improvements").
<br /> F. The Final Map, approved by City Council on July 13, 2011 and recorded on June 27,
<br /> 2011 as Volume 79, Pages 90-92 in the office of the San Mateo County Recorder, divided the property
<br /> into 4 lots hereinafter referred to as the "Overall Site Parcels". A further Final Map for Overall Site
<br /> Parcel 2 was approved by City Council on July 9, 2012 and recorded on November 28, 2012 as Volume
<br /> 138, Pages 47-73 in the office of the San Mateo County Recorder, divided Overall Site Parcel 2 into 60
<br /> ATTY/AGR/2013.053/IMPROVEMENT AGR-BAIR ISLAND RD PHASE II
