�� <br /> JAL- Aug 2011 <br /> form approved by County Counsel, 2003 <br /> AGREEMENT <br /> USE AGREEMENT BETWEEN SAN MATEO COUNTY AND REDWOOD CITY <br /> THI5 AGREEMENT, made and'entered into this �� day <br /> of (iflfl�� , 2011, by and between the COUNTY OF SAN MATEO, a political <br /> subdivision of the State of California, hereinafter called "County", and the City of Redwood <br /> City hereinafter called "City". <br /> WITNESSETH: <br /> WHEREAS, County wishes to plant coastal live oak trees on Assessor Parcel Number <br /> (APN) 095-I51-140, said property belonging to the City of Redwood City, in order to provide <br /> mitigation for channel improvements within the Belmont Creek channel; and <br /> WHEREAS, said mitigation plan is further described in the County's mitigation plan <br /> attached hereto and identified herein as Exhibit "A"; and <br /> WHEREAS, said mitigation plan requires that the site be accessed, initially for tree <br /> planting and ultimately for irrigation and performing routine tree maintenance, including <br /> periodic mulching around trees and trimming of trees; and <br /> WHEREAS, City agrees to allow access to County for the performance of planting and <br /> _1_ <br />
