�������� <br /> � SETTLEMENT AGREEMENT <br /> This Settlement Agreement ("Agreement") is made and entered into as of October 31, <br /> 2014, ("Effective Date"), by and between Brett Leland Colbert ("Owner"), and the City of <br /> Redwood City, a municipal corporation ("City"). Owner and City may each be referred to as a <br /> "Party," and collectively, as the"Parties." ' <br /> RECITALS <br /> A. On or about May 2, 2014, the Owner purchased a single family home located at <br /> 1016 Warren Avenue in Redwood City and more particularly identified as APN 052-258-110-7 <br /> ("Property"). <br /> B. On or about July 24, 2006, the City adopted City Council Resolution No. 14723, <br /> establishing the Mezesville Historical Residential District ("MHRD"), and the Property was <br /> listed as a contributing property to the MHRD. <br /> C. On or about May 28, 2014, the Owner applied for a building permit to remodel <br /> the single family home on the Property. <br /> D. Beginning on or about June 5, 2014 and continuing until about June 20, 2014, the <br /> Owner, who stated that he believed that a building permit would be issued within a matter of <br /> days, substantially demolished the single family home on the Property located within the �D <br /> without obtaining any permission and/or permits from the City in violation of various provisions <br /> of state and local law, including, but not limited to, the City's Municipal Code ("Demolition <br /> Activities"). However, the Owner was mistaken that the pending permit would. authorize <br /> complete demolition of the house or authorize building a new house because building plans for a , <br /> new house(as opposed to a remodeled house)were not submitted to the City. <br /> E. At the time of the Demolition Activities, the Owner alleges he was unaware of the <br /> �D or that his Property was part of it, and after discovering these facts Owner stated he was <br /> very sorry about the loss of a historical resource and desires to give money to the City not only to <br /> redress the loss associated with the Demolition Activities, but also with the sincere hope that the <br /> money he provides, or some portion of it, can be used to educate the public about the MHRD and <br /> the cultural and historical benefits it offers to the community. <br /> F. The Owner is currently pursuing a building permit with the City in an effort to <br /> build a new single family home on the Property consistent with its historical character and which <br /> may require approval through a planning process ("Entitlement Process"). <br /> G. The Parties wish to enter into this Agreement to fully and finally resolve and <br /> settle Owner's liability for the Demolition Activities and provide the City with funds that might <br /> but are not obligated to be used to further the MHRD and public education on the subject. <br /> ATTY/AGR/2014.215/COLBERT SETTLEMENT AGREEMENT-1016 WARREN AVE <br /> REV:10-29-14 PT <br /> Page 1 of 5 <br />
