Code § 27383. <br /> IMPROVEMENT AGREEMENT <br /> Rossi Lane (318-330 West Oakwood Blvd) <br /> THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this <br /> 1 $" day of Mitci , 205—("Effective Date") by and between by and between West <br /> Oakwood, a California Limited Liability Company ("Developer"), and the CITY OF <br /> REDWOOD CITY, a charter city and California municipal corporation ("City") with reference <br /> to the following facts: <br /> RECITALS <br /> A . Developer is the current fee owner of that certain real property consisting of <br /> approximately 1. 1 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br /> B . On March 5, 2014, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals, Resolution No. 14-03, approving the Vesting Tentative Map for Rossi Lane <br /> ("Project"), prepared by MacLeod & Associates and dated January 22, 2014 ("Tentative Map"), subject to <br /> certain conditions of approval ("Conditions"). <br /> C . The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D . Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E . Developer has submitted to City plans, specifications and drawings entitled 318-330 <br /> Oakwood Boulevard West Improvement Plans, prepared by MacLeod & Associates and dated September <br /> 9, 2014 (the "Improvement Plans"), which, in addition to other improvements, provide for certain on-site <br /> public improvements consisting of street improvements, storm drain systems, domestic water systems and <br /> sanitary sewer systems for the Project (collectively, "Improvements"). <br /> F . Upon approval and recordation of the Final Map, the Property will be divided into six <br /> residential lots, hereinafter referred to as the "Residential Parcels", each of which contains a portion of a <br /> Private Street.
