2/27/2017 <br />RESOLUTION NO. 15567 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING A GROUND LEASE AND AMENDMENT TO JOINT <br />USE AGREEMENT <br />WHEREAS, the City of Redwood City (City) owns a plot of real property located <br />at 797 Redwood Shores Parkway (the Property); and <br />WHEREAS, the Belmont -Redwood Shores School District (District) seeks <br />disposition of City property in order to develop a new 13,000 square foot two-story <br />classroom building on City -owned property to accommodate grades K -8th for Sandpiper <br />School and seeks to enter into an amended Joint Use Agreement with the City related <br />to such classroom building (Project); and <br />WHEREAS, the City and District entered into a Joint Use Agreement on June 9, <br />1995 for the joint use of the Sandpiper Park Site; and <br />WHEREAS, the Planning Commission of the City of Redwood City (Commission) <br />is empowered by Article XI, Section 18.60, et. seq. (General Plan Amendment) of the <br />Redwood City Municipal Code, to consider and recommend the amendments to the <br />General Plan to the City Council; and <br />WHEREAS, on December 6, 2016, the Planning Commission conducted a public <br />hearing, in accordance with the City's Real Property Acquisition and Disposal Policy <br />and adopted Resolution 16-24 making a determination of General Plan consistency <br />prior to the disposition of City Property; and <br />WHEREAS, on January 23, 2017, the City Council conducted a public hearing, in <br />accordance with all applicable requirements of the State Planning and Zoning Law, the <br />Redwood City Municipal Code and the Redwood City Zoning Ordinance and approved <br />the Initial Study and Mitigated Negative Declaration further approved the General Plan <br />Amendment. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />Section 1. Pursuant to Article V of Chapter 2 of the Redwood City Municipal <br />Code, the City Council hereby determines that the Property to be leased to the District <br />is not "surplus land," as defined therein. This determination is based on the following <br />facts: <br />1. Under Section 2.42 C.2.a. Of the Municipal Code, <br />lease of the Property will secure community benefits by siting a <br />middle school within Redwood Shores and will further the current <br />park purposes of the Property.
