<br /> DAL:dft ] rt/ 0 7 / 9 0 R (025/8) <br /> o RIG I N A L 2/11/91 <br /> ORDINANCE NO. 2034 <br /> --------- <br /> AN ORDINANCE AWARDING A NON-EXCLUSIVE FRANCHISE TO <br /> CONSTRUCT, OPERATE AND MAINTAIN A CABLE TELEVISION <br /> SYSTEM WITHIN THE CITY OF REDWOOD CITY TO TCI <br /> CABLE VIS ION OF CALIFORNIA, INC. ; ESTABLISHING CERTAIN <br /> CONDITIONS THEREFOR; AND REPEALING ORDINANCE NO. 1906 <br /> AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH <br /> WHEREAS, the City of Redwood City is a member of the Joint <br />Powers Authority known as the "San Mateo Cable Television <br />Authority ( "SAMCAT" ) ; and <br /> WHEREAS, SAMCAT has recommended the adoption by its member <br />agencies of a uniform franchise agreement; and <br /> WHEREAS, the City of Redwood City has adopted a Cablevision <br />Television regulatory and enabling ordinance to conform with the <br />uniform franchise agreement recommended by SAMCAT; and <br /> WHEREAS, this City's current cable television franchisee, <br />TCI Cablevision of California, Inc. ( "TC I ") , the parent company <br />of and the successor in interest to, Nationwide Cablevision, <br />Inc. ; dba peninsula Cable Television Corporation, has agreed to <br />rescind the franchise agreement granted to it pursuant to <br />Ordinance No. 1906, adopted December 17, 1984, by this Council; <br />and <br /> WHEREAS, this Council finds that entering into the proposed <br />franchise agreement with TCI would be in the best interests of <br />the citizens of the City of Redwood City and that the current <br />agreement should be superseded and replaced thereby; and <br /> WHEREAS, Section 15 of the Charter of the City of Redwood <br />City provides that franchises shall be granted by ordinance; <br />
