Declarant is the owner of certain real property commonly known as 2075 <br />Broadway Street, Redwood City, San Mateo County, California (APN 053-131-200) as more <br />particularly described in Exhibit A attached hereto (the "Declarant's Property"). <br />B. The Property is situated adjacent to certain real property owned by the City of <br />Redwood City ("City") commonly known as 1017 Middlefield Road in the City of Redwood City, <br />San Mateo County, California (APN 053-131-140) as more particularly described in Exhibit B <br />attached hereto (the "City's Property") which is currently used for public surface parking. <br />C. Declarant has received planning approval from the City to construct a four <br />story, mixed-use building (the `Building") on Declarant's Property with zero side yard <br />setbacks for the first and second stories. <br />D. Plans for the Building include window openings on the side of the Building <br />facing the City Property (the "Openings"), with specialized shutters that would comply with <br />the fire safety rating requirements of the current California Building Code by approval of an <br />Alternative Materials and Methods of Construction. <br />E. The City has required Declarant to enter into this Declaration for the benefit <br />of the City as a condition of approval of the Alternative Materials and Methods of <br />Construction. <br />n <br />
