06/11/2018 <br />ORDINANCE NO. 2447 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AUTHORIZING DEFERRALS OF PAYMENT <br />FOR CITY FEES ASSOCIATED WITH DEVELOPMENT <br />PROJECTS <br />THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS <br />FOLLOWS: <br />Section 1. All fees associated with the development of real property, other <br />than the Parks Impact Fee, including, without limitation, application fees, impact <br />fees, permit fees, water and sewer connection fees, and inspection fees <br />("Development Fees") shall be due at the time established by applicable <br />ordinance, resolution, or policy. Notwithstanding the forgoing, payment of any <br />Development Fees may be deferred to the date the certificate of occupancy is <br />issued for the development, provided the owner of the real property for which the <br />Development Fees are required enters into an agreement with the City prior to <br />the due date for applicable Development Fees. The agreement shall provide that <br />a certificate of occupancy shall not be issued until the Development Fees are <br />paid. The agreement shall also provide that, in any action to collect the <br />Development Fees or any portion thereof, the City shall be entitled to all of its <br />costs of enforcement and collection, including reasonable attorney's fees. <br />Deferrals and accompanying agreements under this Section shall only be <br />approved by the City Council. Any deferral granted pursuant to this Section shall <br />be consistent with the requirements of Government Code Section 66007. <br />Section 2. The City Council hereby finds that this Ordinance is in the <br />public interest. <br />Section 3. Adoption of this Ordinance is not a project within the meaning <br />of section 15378 of the CEQA Guidelines because it has no potential for resulting <br />in either a direct or a reasonably foreseeable indirect physical change in the <br />environment. <br />Section 4. If any section, subsection, clause or phrase of this Ordinance <br />Amendment is for any reason held to be invalid, such decision shall not affect the <br />validity of the remaining portion or sections of the Ordinance. The City Council of <br />the City of Redwood City hereby declares that it would have adopted the <br />Ordinance and each section, subsection, sentence, clause or phrase thereof <br />irrespective of the fact that any one or more sections, subsections, sentences, <br />clauses or phrases be declared unconstitutional. <br />Section 5.
