06/03/02 <br /> <br /> ORIGINAL <br /> <br /> ORDINANCE NO. 2226 <br /> <br /> ORDINANCE APPROVING AND AUTHORIZING EXECUTION OF <br /> DEVELOPMENT AGREEMENT BETWEEN THE CITY OF <br /> REDWOOD CITY AND JEFF OPFER, AUTHORIZED AGENT FOR <br /> AND ON BEHALF OF ROY E. OPFER AND MARGARET L. <br /> OPFER, AS TRUSTEES UNDER THE TERMS OF SAID <br /> DECLARATION OF TRUST DATED SEPTEMBER 2, 1983 <br /> ("OWNER") AND MAKING CERTAIN FINDINGS WITH RESPECT <br /> THERETO <br /> <br /> (2233 Middlefield Road) <br /> <br /> WHEREAS, an application has been submitted by Jeff Opfer, authorized <br />agent for and on behalf of Roy E. Opfer and Margaret L. Opfer, as Trustees <br />under the Terms of said Declaration of Trust dated September 2, 1983, (the <br />"Applicant") for a development agreement (the "Development Agreement") to <br />develop the property known as 2233 Middlefield Road, Redwood City, California <br />(the "Property"); and <br /> <br /> WHEREAS, on January 15, 2002, the Planning Commission of the City of <br />Redwood City adopted a motion recommending the approval of the Development <br />Agreement to the City Council; and <br /> <br /> WHEREAS, The Development Agreement Law (Government Code, <br />Sections 65864 et seq.) authorizes City to enter into a binding development <br />agreement with any person having a legal or equitable interest in real property, <br />and City desires to enter into a binding development agreement with Applicant; <br />and <br /> <br />F:Atty/Ord/Ord.150 <br />050802~FXS <br /> <br /> <br />
