THIS AGREEMENT, made and entered into this /_~ day of <br /> <br /> . . v , 2002, by and between the CITY OF REDWOOD CITY, a <br />municipal corporation of the State of California, ("City"), and BKF Engineers <br />("Consultant"); <br /> <br /> WlTNESSETH: <br /> <br /> WHEREAS, City proposes to construct the 5th Avenue Storm Drainage <br /> <br />Pump Station in the City of Redwood City (the "Project"); and <br /> <br /> WHEREAS, in connection with the Project, the City requires professional <br />engineering services; and <br /> <br /> WHEREAS, Consultant represents that it possesses the experience, and <br />is qualified to perform the aforesaid services for the Project; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. CONSULTANT'S SERVICES. Consultant shall perform preliminary <br /> <br />design for the 5th Avenue Storm Drainage Pump Station and related services <br /> <br />described in Exhibit "A" hereof, attached hereto and by this reference <br />incorporated herein. <br /> <br /> 2. COMPENSATION; EXPENSES; PAYMENT. City shall compensate <br />consultant for all services performed by Consultant hereunder in an amount <br />based upon Consultant's hourly rates that are prevailing during the time of the <br />performance of said services.
