ORD.!.,NANCE N o. /~9' AN ORDINANCE AMENDING SECTIONS 11.72 AND 11.86 OF, A~u ADDING SECTION 11.89 TO, THE CODE OF THE CITY OF REDWOOD CITY RELATING TO CATV FRANCHISES THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. section 11.72 of Article V of Chapter 11 of the Code of the City of Redwood City is hereby amended to read as "< follows: "Section 11.72 (a) A nonexclusive franchise to construct, operate and maintain a CATV system within all or any portion of the City may be granted by the Council to any person, firm or corporation, whether operating under an existing franchise or not, who or which offers to furnish and provide such system under and pursuant to the terms and provisions of this article. No provision of this article may be deemed or construed as to require the granting of a franchise when in the opinion of the Council it is in the public interest to restrict the number of grantees to one or more. Any franchise granted pursuant to the provisions of this article shall authorize and permit the grantee to engage in the business of operating and providing a CATV system in the City of Redwood City subject to the provisions of all local ordinances concerning the erection, installa- tion, construction, repairing, replacing, reconstructing, maintaining and retaining in, on, over, under, upon, across and along any public street or highway, poles, wires, cables, conductors, ducts, conduits, vaults, manholes, amplifiers, attachments, and other property as may be appurtenant to the CATV system; and in addition, so to use, operate and provide similar facilities or prope,rties rented or leased from a public utility franchised or permitted to do business
