09/09/2019 ORDINANCE NO. 2466 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING REDWOOD CITY CODE SECTION 2.102 (VACANCIES; REMOVAL OF MEMBERS) OF ARTICLE IX (BOARDS AND COMMISSIONS) OF CHAPTER 2 (ADMINISTRATION) OF THE REDWOOD CITY CODE WHEREAS, Section 21 ½ of the Redwood City Charter authorizes the City Council to establish boards and commissions and appoint members of those boards and commissions; and WHEREAS, Section 2.102 of the Redwood City Code establishes that a member of any board or commission may be removed at any time by the affirmative vote of five- sevenths (5/7) of the members of the City Council; and WHEREAS, the City Council is implementing its newly adopted Boards, Commissions and Committees Attendance Policy (Council Policy No. 2019-01); and WHEREAS, the City Council now desires to clarify that the affirmative vote of five- sevenths (5/7) of the City Council is not required for removal of members of boards and commissions pursuant to the Boards, Commissions and Committees Attendance Policy. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. Section 2. This proposed Ordinance amendment has been reviewed with respect to applicability of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.). Adoption of this Ordinance is not a project under CEQA Guidelines Section 15378 because it involves organizational or administrative activities that will not result in direct or indirect physical changes in the environment. Section 3. If any section, subsection, clause or phrase of this Ordinance Amendment is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion or sections of the Ordinance Amendment. The City Council of the City of Redwood City hereby declares that it would have adopted the Ordinance Amendment and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional.
