RESOLUTION NO. 20-01 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />REDWOOD CITY UPHOLDING THE APPEAL BY WINTER KING AND <br />REVERSING THE PLANNING MANAGER'S DECISION TO GRANT <br />CONDITIONAL CERTIFICATE OF COMPLIANCE NO. LL2018-010 <br />REGARDING UNADDRESSED PROPERTY LOCATED ON LAUREL WAY <br />(APN: 057-301-390) <br />WHEREAS, David Hammitt (Applicant) applied for a Certificate of Compliance <br />(LL2018-010) to determine if the subject 7,984 square foot property (APN No. 057-301-390) <br />(the Property) is a legal lot (the Project); and <br />WHEREAS, the Planning Manager of the City of Redwood City is empowered to the <br />grant Certificates of Compliance under the Subdivision Ordinance (Municipal Code Chapter <br />30, Article 13); and <br />WHEREAS, on November 12, 2019, the Planning Manager issued a Conditional <br />Certificate of Compliance (LL2018-010), determining that the property is a legal lot and <br />providing documents to record the Certificate of Compliance with San Mateo County; and <br />WHEREAS, on November 22, 2019, an appeal of the Planning Manager's decision <br />to issue a Conditional Certificate of Compliance was filed with the City Clerk by Winter King <br />of Shute, Mihaly, & Weinberger LLP; and <br />WHEREAS, on February 7, 2020, a public hearing notice was published in the San <br />Mateo Daily Journal and mailed to interested parties and all property owners within 300 feet <br />of the Property; and <br />WHEREAS, on February 18, 2020, the Planning Commission of the City of Redwood <br />City (Planning Commission) held a duly noticed public hearing to consider the appeal in <br />accordance with all applicable requirements of the State Planning and Zoning Law, and the <br />Redwood City Zoning Ordinance and Subdivision Ordinance. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF REDWOOD CITY, AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />Section 2. The Planning Commission finds that the above recitals are accurate and <br />constitute findings in this matter, and with the staff reports, the application materials, and all <br />other documents, reports, oral and written testimony, and materials in the City's file for the <br />application and the Project, and all adopted City planning documents relating to the Project <br />and the Property including the City's General Plan, Municipal Code, Zoning Ordinance, <br />Subdivision Ordinance, Subdivision Map Act, and other applicable City laws and <br />regulations, have together served as an adequate and appropriate evidentiary basis for the <br />findings and actions set forth in this Resolution. <br />ATTY/RESO.0008/PC RESO UPHOLDING APPEAL — WINTER KING & REVISING PLANNING MANAGER'S DECISION <br />REV: 02-14-2020 PR <br />Page 1 of 2 <br />
