RD 08-03 <br /> <br />RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR TO <br />ENTER INTO AN ENVIRONMENTAL OVERSIGHT AGREEMENT <br />WITH THE CALIFORNIA DEPARTMENT OF TOXIC <br />SUBSTANCES CONTROL TO OVERSEE THE REMEDIATION <br />OF THE BRADFORD PARCELS PROPOSED FOR <br />AFFORDABLE HOUSING IN AN AMOUNT NOT TO EXCEED <br />$18,100. <br /> <br />WHEREAS, the Redwood City Redevelopment Agency ("Agency") may take any <br />actions that it the determines are necessary and that are consistent with other state and <br />federal laws to remedy or remove a release of hazardous substances on, under, or from <br />property within a project area if certain conditions are met; and <br /> <br />WHEREAS, the Executive Director may enter into an Environmental Oversight <br />Agreement with the California Environmental Protection Agency's Department of Toxic <br />Substances Control (DTSC) to facilitate the site characterization, remedy selection, and <br />cleanup process; and <br /> <br />WHEREAS, the Agency requests that DTSC provide cleanup guidelines to <br />facilitate the site characterization, remedy selection, and cleanup process; and <br /> <br />WHEREAS, the cleanup objective is to complete a proper cleanup and remedial <br />action that shall lead to a closure letter or certificate that secures specific immunities <br />provided by the Cal. Health and Safety Code for the Bradford Parcels - Assessor Parcel <br />Number 052-372-999, 052-372-200, 052-372-170, and 052-372-240 in order to develop <br />affordable housing; and <br /> <br />WHEREAS, the Environmental Oversight Agreement contains payment terms to <br />reimburse DTSC for its staff time, scope of work, schedule, and standard provisions; <br />and <br /> <br />WHEREAS, the Bradford parcels are within the boundaries of the Redwood City <br />Redevelopment Project Area, and the development of affordable housing will contribute <br />to the Agency's goals and objectives for the Project Area; and <br /> <br />WHEREAS, the remediation of the Bradford parcels leading to future affordable <br />housing will be of benefit to the Project Area and the immediate neighborhood in which <br />the project is located, there are no other reasonable means of financing the Agreement <br />with the State other than the Redevelopment Agency, and the State's oversight will <br />assist towards the elimination of blighted conditions inside the Redwood City Project <br />Area; and <br /> <br />WHEREAS, DTSC is amenable to providing the Agency with oversight and <br /> <br />A TTY/RESO/RESO.1805 <br />040708 <br /> <br />RD 08-03 <br />MUFF # 405 <br />
