Code § <br />27383. <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />One20 Towns at 120 EI Camino Real <br />THIS SUBDIVISION (MPROVEMENT AGREEMENT ("Agreement") is made and <br />entered into on this day _JtMf "R-4 z- , 2021 ("Effective Date") by and between <br />One20th LLC, a Wyoming Limited Liability Com an ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City") (together, <br />the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 0.44 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On April 2, 2019, the Planning Commission, of the City of Redwood City <br />adopted, among other approvals, Resolution No. 19-03, approving the Vesting Tentative <br />Map for the 120 EI Camino Real Development ("Project"), prepared by BKF Engineers <br />and dated December 20, 2018 ("Tentative Map"), subject to certain conditions of approval <br />("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the final map ("Final Map"), or (2) that <br />Developer enter into an agreement with City providing for the future construction of such <br />public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66462(a) (1). <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />120 EI Camino Real Improvement Plans, prepared by BKF Engineers and dated <br />20 �Lo (the "Improvement Plans"), which, in addition to other <br />improvements, provide for certain on-site public improvements consisting of street and <br />REV: 01-06-2021 PR <br />ATTY/AGR.2021.003/Pinn Bros (Page 1 of 22) <br />
