ATTY/RESO.0018/PC RESO FY 24-25 DRAFT CAPITAL IMPROVEMENT PROGRAM <br />REV: 04-30-24 VR <br />Page 1 of 2 <br />RESOLUTION NO. 24-03 <br /> <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />REDWOOD CITY FINDING THAT THE DRAFT CAPITAL IMPROVEMENT <br />PROGRAM FOR FISCAL YEAR 2024-2025 IS CONSISTENT WITH THE <br />GENERAL PLAN <br /> <br />WHEREAS, each year the Planning Commission must review all capital <br />improvement projects that will be planned, initiated or constructed during the ensuing <br />fiscal year for conformity with the General Plan as required by State Planning and Zoning <br />Law (Government Code Section 65401); and <br /> <br />WHEREAS, the Planning Commission has been furnished a copy of and reviewed <br />the Draft Capital Improvement Program for Fiscal Year 2024-2025 (Draft CIP for FY 24- <br />25), for conformity with the Redwood City General Plan; and <br /> <br />WHEREAS, the Planning Commission held a duly noticed public hearing on May <br />7, 2024, at which it considered the Draft CIP for FY 24-25, the General Plan, staff reports, <br />oral and written, and the testimony and evidence of all those wishing to be heard; and <br /> <br />WHEREAS, the Planning Commission’s determination of General Plan <br />consistency is exempt from the California Environmental Quality Act (CEQA) pursuant to <br />CEQA Guidelines Section 15378(b) and CEQA Guidelines Section 15061(b)(3) because <br />a “project” under CEQA does not include administrative activities that will not result in <br />direct or indirect physical changes in the environment. This General Plan consistency <br />determination is an administrative action that does not authorize or otherwise commit the <br />City to any construction or other project which would result in direct or indirect physical <br />changes in the environment. All future CIP projects, if any, will undergo CEQA review at <br />the time they are approved. Further, even if this action was considered a project under <br />CEQA, it would be exempt pursuant to CEQA Guidelines Section 15061(b)(3) because it <br />can be seen with certainty that determining CIP project consistency with the General Plan <br />will not have a significant impact on the environment; and <br /> <br />WHEREAS, each project within the CIP must undergo environmental review <br />before the project is carried out. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The Planning Commission, having independently heard, considered, <br />and weighed all the evidence in the record, finds that the Draft Capital Improvement <br />Program for Fiscal Year 2024-2025 conforms to and is consistent with the Redwood City <br />General Plan, and applicable law. <br />
