P-1337 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> ASSIGNMENT OF LEASE OF PORTSIDE BUILDING NO. 4 <br /> <br /> WHEREAS, The City of Redwood City, acting by and through its <br /> Board of Port Commissioners ("Port") entered into an agreement <br /> May 31, 1984, as amended ("Lease") with Portside Associates which <br /> was subsequently assigned to CLARK'S BY THE BAY, LTD. ("Clarks") <br /> effective 9/23/87 for the purpose of operating the Clark's By the <br /> Bay Restaurant; and <br /> <br /> WHEREAS, Clark's is being acquired by BY THE BAY FOOTBALL, <br /> INC. ("Assignee'); and <br /> <br /> WHEREAS, Clark's desires to assign said Lease to Assignee; <br /> <br /> and <br /> <br /> WHEREAS, Clark's must obtain Port authorization and approval <br /> for assignment. <br /> <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE BOARD OF PORT COMMISSIONERS OF THE <br />CITY OF REDWOOD CITY, AS FOLLOWS: <br /> <br /> 1. This Board hereby approves an assignment of lease by <br />Clark's to Assignee of Portside Building No. 4. <br /> <br /> 2. That certain instrument entitled "Assignment" pursuant <br />to which Clark's assigns a fee interest in the leasehold in <br />Building No.4 for the balance of the LEASE term, a copy of which <br />document is on file in the office of the Port Manager, and to <br />which copy reference is hereby made for full particulars thereof, <br />is hereby approved; and the Port Manager is hereby authorized and <br />directed to execute the aforesaid Assignment for and on behalf of <br /> <br /> <br />
