01/24/2011 <br /> ORIGINAL <br /> RESOLUTION NO. 15081 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br /> DELEGATING AUTHORITY TO CITY ATTORNEY AND CITY MANAGER <br /> TO ADMINISTER AND MANAGE CLAIMS AND ACTIONS AGAINST THE <br /> CITY OF REDWOOD CITY OR ITS OFFICERS OR EMPLOYEES AND <br /> CLAIMS AND ACTIONS OF THE CITY OF REDWOOD CITY <br /> WHEREAS, Government Code §935.4 authorizes a local public entity to delegate to <br /> an employee such functions relating to claims as the local public entity designates; and <br /> WHEREAS, Resolution No.14595 *14476* provides the City Manager authority to <br /> allow, deny, allow in part, settle or compromise claims or actions against Redwood City in <br /> an amount not to exceed fifteen thousand dollars ($15,000) for matters of general liability <br /> and in an amount not to exceed thirty thousand dollars ($30,000) for workers <br /> compensation matters; and <br /> WHEREAS, pursuant to Cal. Gov't Code § 935.4, a charter city may authorize an <br /> employee to allow, compromise, or settle a claim against the local public entity if the <br /> amount to be paid pursuant to the allowance, compromise, or settlement does not exceed <br /> fifty thousand dollars ($50,000) and Redwood City is a charter city; and <br /> WHEREAS, the City Manager (or designee) and City Attorney monitor and evaluate <br /> claims, potential claims, and actions, and in order to protect the City's interests and to <br /> promote efficient and prompt handling of such matters, the City Council desires to delegate <br /> to the City Manager and City Attorney appropriate authority to allow, compromise, or settle <br /> claims, potential claims, and actions within the limits allowed by the Government Code; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redwood <br /> City as follows: <br /> 1. The City Attorney and City Manager are hereby authorized to allow, deny, <br /> allow in part, settle, or compromise any claims, potential claims, or action for <br /> money or damages, including workers compensation claims, against the City <br /> of Redwood City or its officers, or employees, and claims and actions of the <br /> Redwood City against others, provided its disposition is not otherwise <br /> directed by the City Council or by statute, ordinance, resolution, insurance <br /> policy or self- insurance pooling agreement, subject to the following <br /> conditions: <br /> a.
