0~%~1~~ CGM:jp 6/11/79 CGM:jp 7/12/79 R 7/13/79 a AGREEMENT THIS AGREEMENT, made and entered into this day of ~ , 1979, by and between the CITY OF REDWOOD CITY, a municipal corporation, hereinafter referred to as "City", and SAN MATEO COUNTY SCAVENGER COMPANY, a subsidiary of Browning-Ferris Industries, a corporation, hereinafter re- ferred to as "Company"; WI TNE S S E TH : WHEREAS, City and Company wish to enter into an agreement by which Company is granted the exclusive contract right, license, and privilege to collect and dispose of all garbage, rubbish and waste matter accumulated within City; NOW, THEREFORE, it is hereby agreed as follows: 1. Term. City grants to Company the exclusive license, contract, right and privilege to collect and dispose of all garbage, rubbish and waste matter, as herein defined, accumulated in City, for a period of ten (10) years, commencing July 1, 1979, and ending at midnight June 30, 1989, excepting as hereinafter provided. By mutual agreement, the parties may renew this agreement for an additional five (5) year period and for succes- sive one (1) year periods thereafter; provided, however that this agreement may be terminated without cause by either party during any such one year renewal upon written notice given to the other party not less than six (6) months prior to the effective date of such termination. 2. Garbage Defined. The word "garbage" shall for the purposes of this agreement include all matter defined as gar- bage, rubbish, waste matter, or refuse in Section 14.1 of the Redwood City Code, as amended, or any successor thereof; provided, however, that dirt, rock, wood plaster, and brick waste, are hereby excluded from the definition of garbage.
