RESOLUTION NO. 14-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF REDWOOD CITY DENYING THE APPEAL OF C. SCOTT POWERS AND UPHOLDING THE DECISION OF THE ZONING ADMINISTRATOR DENYING VARIANCE NO. V2013-03 FOR 74 MANOR COURT PURSUANT TO THE REDWOOD CITY ZONING CODE WHEREAS, the Applicant, C. Scott Powers, filed an application for a Variance to construct a detached accessory structure within the side and rear yard setbacks at the property located at 74 Manor Court, Redwood City, California; and WHEREAS, on November 13, 2013, the Zoning Administrator conducted a duly noticed public hearing, in accordance with all applicable requirements of the State Planning and Zoning Law and the Redwood City Zoning Ordinance, to consider approval of Variance Application No. V2013-03, and received and considered oral and documentary evidence on the application; and WHEREAS, on November 26, 2013, the Zoning Administrator issued a Notice of Official Action for Variance Application No. V2013-03, denying the application because the required variance findings could not be made; and WHEREAS, on December 11, 2013, an appeal of the Zoning Administrator's decision to deny the Variance was filed with the City Clerk by the Applicant; and WHEREAS, on January 24, 2014, a public hearing notice was published in The Redwood City Daily News and mailed to interested parties and all property owners within 300 feet of the Property; and WHEREAS, on February 4, 2014, the Planning Commission of the City of Redwood City held a duly noticed public hearing in accordance with all applicable requirements of the State Planning and Zoning Law and the Redwood City Zoning Ordinance, to consider the appeal of the Zoning Administrator action on Variance Application No. V2013-03; and WHEREAS, on February 4, 2014, the Appellant and all other interested parties were given the opportunity to participate in the public hearing through oral testimony and the submittal of written comments; and WHEREAS, on February 4, 2014, the Planning Commission fully reviewed, considered, and evaluated the staff reports prepared for the Project including the attachments to the staff reports, oral and written public testimony, and all other documents and evidence in the public record on the Project and the appeal.
