<br /> 08/09/2004 <br /> ORIGINAL <br /> ORDINANCE NO. 2269 <br />ORDINANCE OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br />AMENDING CHAPTER 27A OF THE REDWOOD CITY MUNICIPAL <br />CODE BY ADDING ARTICLE II, RELATING TO STORMWA TER <br />TREATMENT MEASURES AND MAINTENANCE PROGRAM <br />The Council of the City of Redwood City does ordain as follows: <br />Section 1. Legislative Findings. The Council finds and declares as follows: <br />Regional <br />A. By Order No. R2-2003-0023, the State Water Resources Control Board <br /> ("SWRCB") has modified the National Pollutant Discharge Elimination <br /> System ("NPDES") Permit Order No. 99-059, CASO029921 issued to the <br /> County of San Mateo Stormwater Pollution Prevention Program regulating <br /> the discharge of stormwater runoff to local creeks by municipalities of San <br /> Mateo County. The new permit provisions mandate that the municipalities <br /> develop and enforce regulations that require owners/developers of <br /> applicable projects to install and maintain permanent stormwater quality <br /> protection measures in accordance with specific design criteria. <br />B. Under the terms of the municipal NPDES permit and its amendments, <br /> beginning July 1, 2004, municipalities are required to enter into <br /> Stormwater Treatment Measures Maintenance Agreements with <br /> owners/developers of applicable projects as hereinafter described. Each <br /> municipality is required to annually report to the San Francisco Bay <br /> Regional Water Quality Control Board (RWQCB) the status of such <br /> operation and maintenance program. <br />C. Effective February 15, 2005, the regulations will apply to projects that <br /> create or replace one acre or more of impervious surface (Group I <br /> projects, as hereinafter defined). Permit applications for private projects <br /> deemed complete prior to February 15, 2005, and public projects for which <br /> funding has been committed and for which construction is scheduled to <br /> begin by February 15, 2005, will not be subject to the new regulations. <br />D. The City of Redwood City (as well as all other cities in San Mateo County) <br /> will be adopting new stormwater regulations that apply to land <br /> development projects that create or replace one acre or more of <br /> impervious surface. <br />AttylOrdlOrd.216 2269 <br />063004 1 Muff#802 <br />"---"- <br /> II <br />
