<br />. . <br /> <br />. <br /> <br />( . . <br /> <br />AGREEMENT - SEWAGE TRANSMISSION, TREATMENT, AND <br />DISPOSAL OF SANlTARY SEWAGE (EMERALD LAKE HILLS <br />AREA) - SUPPLEMENT NO.2 <br /> <br />THIS <br /> <br />AGREEMENT, <br /> <br />made <br /> <br />and entered <br /> <br />into <br /> <br />this <br /> <br />Ii! <br /> <br />day of <br /> <br />J'.~, 1985", by and between the CITY OF REDWOOD CITY, <br /> <br />a municipal corporation of the State of California ("City") <br /> <br />and the COUNTY <br /> <br />OF <br /> <br />SAN <br /> <br />MATEO, <br /> <br />a <br /> <br />political <br /> <br />subdivision <br /> <br />of <br /> <br />the <br /> <br />State of California ("County"); <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, <br /> <br />the <br /> <br />City <br /> <br />and County entered <br /> <br />into <br /> <br />an <br /> <br />agreement <br /> <br />entitled <br /> <br />"Agreement <br /> <br />for <br /> <br />Sewage <br /> <br />Transmission, <br /> <br />Treatment, <br /> <br />and <br /> <br />Disposal of Sanitary Sewage By and Between the City_of Redwood <br /> <br />City, <br /> <br />the <br /> <br />County <br /> <br />of <br /> <br />San Mateo <br /> <br />and <br /> <br />the <br /> <br />Emerald- Lake Heights <br /> <br />Sewer Maintenance District," dated August 22, <br /> <br />1983, <br /> <br />(hereafter <br /> <br />.. Agreement" ) , <br /> <br />designating <br /> <br />certain <br /> <br />territory <br /> <br />as <br /> <br />the <br /> <br />Emerald <br /> <br />Lake Hills Area and mapped as such on Exhibit "A" of the above <br /> <br />cited Agreement; and <br /> <br />WHEREAS, pursuant to Paragraph XI, <br /> <br />the Agreement provides <br /> <br />that <br /> <br />revisions, <br /> <br />alterations, <br /> <br />and amendments <br /> <br />to <br /> <br />the Agreement <br /> <br />may be made by written agreement supplemental to the Agreement; <br /> <br />and <br /> <br />WHEREAS, <br /> <br />both <br /> <br />parties <br /> <br />agree <br /> <br />that <br /> <br />said <br /> <br />annexation <br /> <br />shall <br /> <br />not .chanqe or affect in any way the treatment capacity allocation <br /> <br />previously purchased by the County (0.50 M.G.D.); aúd further, <br /> <br />said <br /> <br />annexation <br /> <br />shall <br /> <br />be <br /> <br />applied <br /> <br />to <br /> <br />Redwood <br /> <br />City's <br /> <br />present <br /> <br />sewer treatment capacity allocation; and <br /> <br />WHEREAS, <br /> <br />the <br /> <br />parties <br /> <br />hereto <br /> <br />desire <br /> <br />to <br /> <br />provide <br /> <br />for <br /> <br />the <br /> <br />boundary change of the Emerald Lake Hills Area, for the benefit <br /> <br />of <br /> <br />certain <br /> <br />described <br /> <br />properties <br /> <br />and <br /> <br />particularly <br /> <br />described <br /> <br />below, subject to all of the terms and conditions of the Agree~e~~ <br /> <br />-1- <br />
