<br />MSR:sw:6/l4/77 <br /> <br />0 R DIN A N C E <br /> <br />~ Q. 170 9 <br /> <br />ORIGINAL <br />JON 2 7 1977 <br /> <br />--------- <br /> <br />ORDINANCE ADDING ARTICLE II TO CHAPTER 33A OF THE <br />CODE OF THE CITY OF REDWOOD CITY, RELATING TO USES <br />OF RIGHTS OF WAY (BROADWAY MALL) <br /> <br />THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. <br /> <br />Article II is hereby added to Chapter 33A of <br /> <br />the Code of the City of Redwood City to read as follows: <br /> <br />"ARTICLE II. <br /> <br />USE OF THE BROADWAY MALL. <br /> <br />For the purposes of this <br /> <br />"Section 33A.15. <br /> <br />Definition. <br /> <br />Article, the terms 'Broadway Mall,' <br /> <br />'Broadway' and 'Mall' as used <br /> <br />herein shall be interchangeable and shall mean the landscaped and <br /> <br />tiled sidewalk beginning at EI Camino Real, easterly along both <br /> <br />sides of Broadway to Marshall Street, thence southerly along both <br /> <br />sides of Arguello Street from Marshall Street to Broadway, thence <br /> <br />along both sides of Broadway between Arguello Street and Maple <br /> <br />Street. <br /> <br />Additionally, the aforementioned terms shall also include <br /> <br />those areas of the streets intersecting Broadway and situated <br /> <br />between El Camino Real and Maple Street, that are 75 feet or less <br /> <br />from the centerline of Broadway. <br /> <br />"Any tiled sidewalk which is not a part of the public right- <br /> <br />of-way is expressly excluded from this article. <br /> <br />Purpose. <br /> <br />The Broadway Mall has been <br /> <br />"Section 33A.16. <br /> <br />designed and constructed primarily as a pedestrian promenade and <br /> <br />to enhance pedestrian access to stores and businesses located <br /> <br />adjacent thereto. <br /> <br />It is the purpose and intent of the City <br /> <br />Council, by this article, to promote such utilization of a <br /> <br />revitalized Broadway Mall in furtherance of and in a manner <br /> <br />consistent with the public health, safety, welfare and interest. <br /> <br />"Section 33A.17. <br /> <br />Permit Required. <br /> <br />It shall be unlawful for <br /> <br />any person to erect, maintain or place, or permit the erection, <br /> <br />maintenance or placement of, any encroachment within, in, on, <br /> <br />170~ <br />
