'1'he word 'tree' shall be defined, unless oth('r-- <br /> <br />wise indicated in this chapter, as (a) any \'lOody plant <br /> <br />c11cu:actorized by having a single trunk of a. circumference <br /> <br />of 38 inches or more, measured at any point between six <br /> <br />inches and 36 inches above ground level, or (b) an~T woody <br /> <br />plant c11aracterized by having a single trunk which has been <br /> <br />found by the Park and Recreation COlmnission to have special <br /> <br />signific~nce to the community, which plant shall be desig~ated <br /> <br />a 'heritage tree'" <br /> <br />"Commission. The word 'commission' shall be defined <br /> <br />as t,he Park and Recreation Commiss ion. <br /> <br />"Section 35.2 'rhe Commission may declare any tree, <br /> <br />rega~dless of size, to be a heritage tree under this chapter <br /> <br />if said tree is healthy and has adapted well to the climatic <br /> <br />conditions of the area, if said tree is visually accessible <br /> <br />from a publ:Lc right of way and if the Commies i.on finds t.ha t <br /> <br />at least one of the following conditions exist: <br /> <br />"(a) 'l'hat said tree bas historical significance, <br /> <br />~(b) That said tree is indigenrnlG to the area, <br /> <br />r <br />
