<br />09/24/2007 <br /> <br />ORIGINAL <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING THE SECOND AMENDMENT OF THE FRANCHISE <br />AGREEMENT BETWEEN THE CITY OF REDWOOD CITY AND <br />ASTOUND, LLC (FORMERLY RCN TELECOM SERVICES, INC) TO <br />PERMIT ITEMIZATION OF PUBLIC, EDUCATIONAL AND <br />GOVERNMENTAL (PEG) ACCESS FEES ON SUBSCRIBERS BILLS <br /> <br />WHEREAS, in August 2000, the City Council of the City of Redwood City, <br />California ("City") granted a Cable Television Franchise ("Franchise") to RCN Telecom <br />Services of California, Inc, which subsequently provided services as RCN Telecom <br />Services, Inc., and <br /> <br />WHEREAS, in September 2004, said Franchise was amended to change the <br />method by which construction compliance is regulated and to provide for the creation of <br />a multi-jurisdictional fiber network within Redwood City and neighboring communities; <br />and <br /> <br />WHEREAS, in January 2007, said Franchise was transferred from RCN Telecom <br />Services, Inc, to Astound Broadband, LLC; and <br /> <br />WHEREAS, Astound now requests that it be permitted to itemize public, <br />educational and governmental (PEG) access fees on its subscribers bills; and <br /> <br />WHEREAS, city staff does not believe that such an amendment will result in any <br />significant adverse impacts to Redwood City customers. <br /> <br />NOW, THEREFORE THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br />HEREBY ORDAIN AS FOLLOW: <br /> <br />1. That the second amendment to the Franchise, attached as Exhibit A and <br />incorporated herein by reference, is approved and the City Manager is authorized to <br />execute same. <br /> <br />2.
