01 /09/2012 <br /> ORIGINAL <br /> ORDINANCE NO. 2374 <br /> AN ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING VARIOUS <br /> SECTIONS OF THE REDWOOD CITY MUNICIPAL CODE RELATING TO <br /> APPEALS AND DELETING VARIOUS INOPERATIVE PERMIT <br /> REQUIREMENTS WHICH ARE NO LONGER APPLICABLE <br /> WHEREAS, the appeal provisions of the Municipal Code are in need of updating to bring <br /> consistency to the various sections. <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br /> ORDAIN AS FOLLOWS: <br /> Section 1. Subsection B of section 2.126 of the Redwood City Municipal Code regarding <br /> appeals to the Board of Building Review is hereby amended to read as follows: <br /> B. Every appeal, as provided by subsection A of this Section, shall be in writing on <br /> forms approved by the Board of Building Review and furnished by the Buiiding <br /> Inspector. Every such appeal shail be filed with the Building Inspector at least fifteen <br /> (15) days prior to being considered by the Board. Every such appeal shall indicate <br /> the Code provision or provisions concerned, the nature of the appeal, the type of <br /> material or construction intended to be used, and shall be accompanied by such <br /> drawings, plans, information or other materials deemed appropriate by the Board. <br /> Section 2. Section 3.99 of the Redwood City Municipal Code regarding signs is hereby <br /> amended to read as follows <br /> 3.99. - REVIEW AND APPROVAL PROCESS: <br /> The Director shall make a determination on any sign variance request in the same <br /> manner as any other sign-related decision. If approved, a sign variance shall become <br /> effective on the fifteenth (15th) calendar day following the date of the final decision; <br /> uniess the matter is appealed, which appeal will stay the effectiveness of the permit or <br /> determination until the appeal is finally resolved. <br /> Section 3. Section 3.113 of the Redwood City Municipal Code regarding signs is hereby <br /> amended to read as follows <br /> 3.113. - REVIEW AND APPEAL PROCESS FOR PERMITS AND SIGN-RELATED <br /> DECISIONS: <br /> A. Levels of Review: All matters of enforcement, interpretation and application of this <br /> Article, including all sign-related decisions, shall be made initially by the Director as <br /> an administrative matter, with no public hearing required. The Director's decision <br /> may be appealed to the Planning Commission for public hearing. The Planning <br /> Commission's decision is final as to the City, but may be subject to judicial review. <br /> B. Rules of Decision: The Director shall approve all sign permit applications which fully <br /> compiy with the requirements of this Article and all other applicable laws, rules, <br /> ATTY/ORD.362/AMENDING MUNI CODE APPEAL ORD. # 2374 <br /> REV: 12/13/11 FORMERLY MUFF # 305 <br /> Page 1 of 17 <br />
