11/25/2019 <br />ORDINANCE NO. 2472 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AMENDING ARTICLES I AND II OF CHAPTER <br />24 OF THE REDWOOD CITY CODE RELATING TO NOISE <br />REGULATION <br />WHEREAS, Chapter 24 (Noise Regulation) Article II (Excessive and <br />Unreasonable Noises) Division 3 (Construction) of the Redwood City Code regulates <br />excessive noise generated by construction activities; and <br />WHEREAS, the City Council now desires to amend Chapter 24, Article I to <br />add a definition for construction; and <br />WHEREAS, the City Council now desires to amend Chapter 24, Article II to <br />expand what is deemed to be excessive and unreasonable noises and to address <br />time limitations for construction related noises; and <br />WHEREAS, the City Council of Redwood City is the decision- making body for <br />this ordinance. <br />NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />Section 1. The foregoing recitals are true and correct and constitute the <br />findings in this matter. <br />Section 2. The City Council hereby finds that the proposed Ordinance is in <br />the public interest. <br />Section 3. The proposed Ordinance is not a project within the meaning of <br />section 15378 of the CEQA Guidelines because it has no potential for resulting in <br />either a direct or a reasonably foreseeable indirect change in the environment. <br />Section 4. If any section, subsection, clause or phrase of this Ordinance is <br />for any reason held to be invalid, such decision shall not affect the validity of the <br />remaining portion or sections of the Ordinance. The City Council of the City of <br />Redwood City hereby declares that it would have adopted the Ordinance and each <br />section, subsection, sentence, clause or phrase thereof irrespective of the fact that <br />any one or more sections, subsections, sentences, clauses or phrases be declared <br />unconstitutional. <br />Section 5. The City Council of the City of Redwood City adopts the following <br />amendment to Section 24.2 of the Redwood City Code by adding the text shown in <br />underline (example), as provided in Exhibit A, which is attached hereto and <br />incorporated herein by reference.
