ATTY/RESO.0022/PS RESO 77 BIRCH STREET <br />REV: 05-16-24 VR <br />Page 1 of 5 <br />RESOLUTION NO. 24-04 <br /> <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />REDWOOD CITY APPROVING AN ARCHITECTURAL PERMIT, <br />VESTING TENTATIVE MAP, CONDOMINIUM PERMIT, AND PLANNED <br />DEVELOPMENT PERMIT SUBJECT TO CONDITIONS OF APPROVAL <br />FOR THE PROJECT LOCATED AT 77 BIRCH STREET <br /> <br />WHEREAS, the applicant, 77 Birch LLC (the “Applicant”), filed an application for <br />an Architectural Permit, Vesting Tentative Map, Condominium Permit and Planned <br />Development Permit to demolish an existing single-story office building and construct two <br />4-story buildings containing nine for-sale townhome units (the “Project”) at 77 Birch Street <br />(the “Property”); and <br /> <br />WHEREAS, pursuant to Article 41 of the Redwood City Zoning Code, the Planning <br />Commission shall take action on all applications involving new building construction <br />exceeding three stories or 35 feet in height; and <br /> <br />WHEREAS, on May 10, 2024, at least ten days before to the hearing date, a notice <br />of the Planning Commission hearing was mailed to owners and occupants within 300 feet <br />of the project site, emailed to interested parties, published in the San Mateo Daily Journal, <br />and posted on the City’s website; and <br /> <br />WHEREAS, on May 21, 2024, the Planning Commission held a duly noticed public <br />hearing in accordance with all applicable requirements to review the Project and <br />supporting materials; <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION <br />OF THE CITY OF REDWOOD CITY HEREBY FINDS AS FOLLOWS: <br /> <br />Section 1. The recitals set forth above are true and correct and are incorporated <br />herein by these references as if fully set forth in their entirety. <br /> <br />Section 2. The Planning Commission, having independently heard, considered, <br />and weighed all the evidence in the record, finds that the above recitals are accurate and <br />constitute findings in this matter and, together with the staff report and the application <br />materials, including without limitation the CEQA determination, and all other documents, <br />reports, studies, memoranda, maps, oral and written testimony, and materials in the City’s <br />file for the applications and the Project, and all adopted City planning documents relating <br />to the Project and the property including the City’s General Plan, Zoning Ordinance, <br />Municipal Code, other applicable City laws and regulations, have together served as an <br />adequate and appropriate evidentiary basis for the findings and actions set forth in this <br />Resolution. <br /> <br />
