ATTY/ORD.0005/CC ORD FEE DEFERRAL <br />REV: 06-13-25 VR <br />Page 1 of 5 <br />ORDINANCE NO.2549 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY REPEALING ORDINANCE NO. 2477 AUTHORIZING DEFERRALS <br />OF PAYMENT FOR CITY FEES ASSOCIATED WITH DEVELOPMENT <br />PROJECTS AND ADDING REDWOOD CITY MUNICIPAL CODE <br />CHAPTER 18 (LOCAL IMPROVEMENTS & PLANNING), ARTICLE XVII <br />(DEVELOPMENT FEE DEFERRALS) AND AMENDING SECTION <br />18.258.C (IMPOSITION AND PAYMENT OF PARKS IMPACT FEE) FOR <br />INTERNAL CONSISTENCY <br />WHEREAS, the Redwood City Municipal Code is a collection of ordinances <br />passed by the City Council which governs certain activities within the City which set forth <br />the rules and regulations for a very wide variety of situations and issues, including but not <br />limited to land development, building construction, fire prevention, health and sanitation; <br />and <br />WHEREAS, the City’s Municipal Code serves to promote the public health, safety, <br />and general welfare of the community; and <br />WHEREAS, California State Legislature has made changes to state laws to <br />streamline residential development projects, including, but not limited to, changes to the <br />timing for payment of impact fees for qualified residential development projects; and <br />WHEREAS, the City’s Municipal Code requires changes to comply with these <br />updated laws and to clarify existing regulations and procedures; and <br />WHEREAS, Chapter 18 (Land Development and Planning) requires additions to <br />clarify the impact fee deferral process and procedure (the “Chapter 18 Additions”); and <br />WHEREAS, Section 18.258.C (Imposition and Payment of Parks Impact Fee) <br />requires amendments for internal consistency with the proposed Chapter 18 Additions <br />(the “Section 18.258.C Amendments”); and <br />WHEREAS, the Chapter 18 Additions, the Section 18.258.C Amendments, and <br />the repeal of uncodified Ordinance No. 2477 (collectively, the “Municipal Code <br />Amendments”) are in the best interest of the City, and Article XI, Section 7 of the California <br />Constitution allows cities to make and enforce local ordinances and regulations not in <br />conflict with the general laws of the state; and <br />WHEREAS, the City Council of the City of Redwood City considered the Municipal <br />Code Amendments at its regular meeting of June 23, 2025 along with the staff report, <br />supporting documentation, staff presentations, public comment, and information included <br />in the record.
