<br />12/14/2009 <br /> <br />ORIGINAL <br /> <br />ORDINANCE NO. 2349 <br /> <br />ORDINANCE AMENDING CHAPTER 20, ARTICLE VII, <br />SECTIONS 20.95.1 C, 20.95.2, 20.132, AND 20.191 OF THE <br />CODE OF THE CITY OF REDWOOD CITY RELATING TO <br />OVERTIME PARKING; ISSUANCE OF CITATION; PAYMENT OF <br />FINE <br /> <br />WHEREAS, parking violation fines are considered a civil penalty and may <br />be set by the governing body of a local jurisdiction pursuant to California Vehicle <br />Code section 40200 et seq.; and <br />WHEREAS, parking violation fines set forth in Article VII of Chapter 20 of <br />the Redwood City Municipal Code regulate overtime parking, issuance of citation, <br />and payment of fine; and <br />WHEREAS, Senate Bill 1407, effective January 1, 2009, amended <br />Government Code Section 70372(b) to require the City to submit $4.50 per <br />parking citation to the County Treasurer for state court construction projects; and <br />WHEREAS, increasing the fine to include the added surcharge of $4.50 <br />must be rounded up to $5.00 as DMV will not accept less than whole dollar <br />amounts; and <br />WHEREAS, the City Council desires to increase all parking fines an <br />additional $5 to maintain parity with surrounding jurisdictions; and <br />WHEREAS, increasing parking fines by $10 will help the City maintain <br />and/or increase its revenue stream by recouping redirected funds to meet its <br />rising expenses. <br />NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Section 20.95.1.C of the Municipal Code of the City of <br />Redwood City is amended to read as follows: <br />C. Any operator or owner of a vehicle to whom a citation has been <br />issued in accordance with the preceding subsection may, within <br />fifteen (15) (business) days of the time of the issuance of such <br />citation, pay to the appropriate court, as a penalty for the full <br /> <br />Atty/Ord/Ord.324 <br />120109 <br /> <br />1 <br /> <br />2349 <br />FORMERLY MUFF # 703 <br />
