R E S 0 L U T I 0 N N 0. 1682 <br />GRANTING VARIANCE TO D. GARRETO TO <br />ALLOW TEN FOOT (10 FRONT YARD <br />SETBACK ON LOTS 36 AND 37, McGARVEY'S <br />SUBDIVISION. <br />WHEREAS, the Planning Commission of the City of <br />Redwood City, State of California, has submitted the <br />application of D. GARRETO for a variance with the recom- <br />mendation that such application be granted, and <br />WHEREAS, the Council of the City of Redwood City <br />has considered said application for variance in <br />accordance with Section 20 of Ordinance No. 600 said <br />ordinance being the Zoning Ordinance of the City of <br />Redwood City, <br />NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY HEREBY <br />RESOLVES AS FOLLOWS: <br />1. Said Council finds the following conditions <br />exist: <br />(a) That there are exceptional or extraordinary <br />circumstances which apply to the land, building or <br />use referred to in the application, which circum- <br />stances or conditions do not generally apply to <br />land, buildings or uses in the same district. <br />(b) That the granting of the application is <br />necessary for the preservation and "enjoyment of <br />substantial property rights of the petitioner. <br />(c) That the granting of such application <br />will not materially affect adversely neighboring <br />property or the public welfare or the health or <br />safety of persons residing or working in the <br />neighborhood. <br />2. Said Council hereby grants to D. GARRETO a <br />variance in the front yard requirements on Lots 36 and 37, <br />McGarveyts Subdivision to allow construction of improvements <br />within ten (10 ) feet of the front property line on said <br />property, and further, upon the condition that the con- <br />- 1 - <br />
