6/1/98 <br /> <br /> ORIGINAL <br /> <br /> ORDINANCE NO. 2143 <br /> <br /> ORDINANCE APPROVING AND AUTHORIZING EXECUTION <br /> OF THIRD AMENDMENT TO FRANCHISE AGREEMENT WITH <br /> BROWNING-FERRIS INDUSTRIES OF CALIFORNIA, INC., FOR <br /> SOLID WASTE COLLECTION SERVICES <br /> <br /> WHEREAS, pursuant to Ordinance No. 1960, adopted October 12, 1987, <br />the Council of the City of Redwood City approved and authorized the execution <br />of a Uniform Franchise Agreement with Browning-Ferris Industries of California, <br />Inc. ("BFI") for solid waste collection services, effective as of October 1, 1987 <br />(the "Master Franchise"); and <br /> <br /> WHEREAS, pursuant to Ordinance No. 2077, adopted April 11, 1994, the <br />Council of the City of Redwood City approved and authorized the execution of a <br />First Amendment amending the Master Franchise effective April 26,1994; and <br /> <br /> WHEREAS, pursuant to Ordinance No. 2132, adopted September 7, <br />1997, this Council approved and authorized the execution of a Second <br />Amendment amending the Master Franchise to extend the notice of termination <br />deadline from September 30, 1997 to June 30, 1998; and <br /> <br /> WHEREAS, the City of Redwood City is a member agency of the South <br />Bayside Transfer Station Authority ("Authority"), a public agency established <br />pursuant to the California Joint Exercise of Powers Authority Act (Govt.
