I <br />O R I G I N A L 02/24/03 <br />RESOLUTION NO. 14508 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />AUTHORIZING ACQUISITION OF PROPERTY AND THE EXPENDING OF FUNDS <br />THEREFOR, AND THE INSTITUTION OF EMINENT DOMAIN PROCEEDINGS <br />ASSESSOR'S PARCEL NO. 052- 366 -050 <br />(OWNER(S): Magnolia Tree, LLC, a Delaware limited liability company) <br />WHEREAS, the Government Code of the State of California Sections 37350.5, 37353, and <br />40404, and Code of Civil Procedure Sections 1230.020, 1240.010, 1240.020, 1240.110, and 1240.120, <br />et seq., provide for the acquisition of private property necessary to carry out any of the City's powers or <br />functions and for the public use described herein; and, <br />WHEREAS, the public interest and necessity require the acquisition of fee title to the real <br />property hereinafter described above, for a public use, namely, for a public parking facility in the City <br />of Redwood City ( "the Project "); and, <br />WHEREAS, pursuant to the Code of Civil Procedure Section 1245.235, notice and an <br />opportunity to be heard was given to the owner(s) of the property which is the subject of this <br />Resolution as the person(s) shown on the last equalized county assessment role; and, <br />WHEREAS, pursuant to Government Code Section 7267.2 the owner(s) of record was offered <br />just compensation for the real property hereinafter described; and, <br />WHEREAS, the public interest and necessity require the acquisition of the property hereinafter <br />described on Exhibit "A ", for a public use, namely, an underground public parking facility consisting of <br />590 parking spaces; and, <br />WHEREAS, the City of Redwood City is authorized to exercise the power of eminent domain <br />for the purpose of taking such property by virtue of Government Code Sections 37350.5, 37353 and <br />40404 and Code of Civil Procedure Sections 1230.020, 1240.010, 1240.020, 1240.110, and 1240.120; <br />and <br />WHEREAS, the City of Redwood City has prepared and certified as complete the Final <br />Environmental Impact Report and approved by Resolution the Addendum to the Environmental Impact <br />Report as being in compliance with California Environmental Quality Act ( "CEQA "), found in Public <br />(page 1 of 4) <br />
