RE S GLUT I ON N0_ ' 454-1 <br />REG:yc:1 -7 <br />RESOLUTION OF INTENTION TO AMEND ORDINANCE NO. 1130, THE <br />ZONING ORDINANCE, RELATING TO THE ADOPTION OF AMENDMENTS <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br />AS FOLLOWS: <br />1. Pursuant to Article 41 of Ordinance No. 1130 this <br />Council hereby declares its intention to initiate proceedings <br />to amend said ordinance in the manner hereinafter specified. <br />2. The proposed amendment consists of amending Section 41,8 <br />to read as follows: <br />"Section 41.8 Council Action. (a) At- the- eeeelueiee <br />ef- the- pablie- he"img -the The Council shall take action <br />on each proposed amendment as follows: <br />11 (1) Terminate proceedings or deny the property owner's <br />application if it finds that the proposed amend- <br />ment is not in the public interest. <br />"(2) Adopt the proposed amendment, subject to such <br />modifications as the Council finds proper, by <br />ordinance, if it finds that it is in the public <br />interest. <br />11 (3) Refer the proposed amendment or a proposed modifi- <br />cation back to the Commission for further review. <br />��- the- 6et�ee�� -�} eels- �ha� �tee����ea��ee �e- aeeesea�� <br />e�- dea�ea��e- p��e�- �e- as�ep��eeT <br />"(b) In the event the Council �leetees- ha- a -ee�- <br />ease- ehett�e�- lie- mae�eT refers back an amendment or modi- <br />fication to the Commission, the Commission shall, by motion, <br />make its recommendation on the proposed amendment and modi- <br />fication to the Council. No public hearing need be held on <br />the proposed modification by the Commission. Failure to <br />make a recommendation within 40 days shall be deemed to be <br />approval of the modification. Upon receipt of the Commission's <br />recommendation, the Council shall hold a final public hearing <br />as provided by Section 41.7, at the conclusion of which the <br />Council may adopt the proposed amendment with- er- withettt <br />
