O1/09/2012 <br /> ORIGINAL <br /> RESOLUTION NO. 15162 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY ESTABLISHING SOLID WASTE COLLECTION RATES <br /> WHEREAS, pursuant to agreement with the South Bayside Waste Management <br /> Authority (SBWMA), a rate analysis has been conducted regarding solid waste collection <br /> rates in the City of Redwood City; and <br /> WHEREAS, upon the recommendation of said Authority, of which this City is a member <br /> agency, revisions to the rates of charge for said purposes have been proposed; and <br /> WHEREAS, pursuant to the provisions of Section 14.31 of the Municipal Code of the <br /> City of Redwood City, schedules of charges for such purposes shall be established by <br /> resolution of this Council; and <br /> WHEREAS, the City Council's action is not a"projecY' pursuant to CEQA Guidelines <br /> section 15378(b)(4) because the City is setting maximum rates for solid waste collection to be <br /> charged by Recology San Mateo County which are intended to fund on-going solid waste <br /> collection services, and as such, the action involves a funding mechanism or fiscal activity <br /> within the meaning of the CEQA Guidelines; and <br /> WHEREAS, notices were sent as required by Government Code Section 53755, a <br /> hearing was held in accordance with the requirements of Article XIII D, Section 6 of the <br /> California Constitution (Proposition 218), no majority protest exists, and the proposed rate <br /> increase complies with the limitations for use in Article XIII D, Section 6(b). <br /> NOW, THEREFORE BE IT RESOLVED that the Council of the City of Redwood City <br /> hereby approves, as follows: <br /> 1. The schedule of charges for solid waste collection services in the city of Redwood City <br /> is hereby established as set forth In Exhibit "A," attached hereto and by this reference <br /> Incorporated herein <br /> 2.
