<br />ORIGINAL <br /> <br /> <br /> AGREEMEMT <br /> for <br /> <br />ABANDONED SHOPPING CART RETRIEVAL PROGRAM <br /> <br /> THIS AGREEMENT, made and entered into this 30TH day of November, 2001, by <br />and between ALBERTSONS # 7127 ('Participating Owner") and the CITY OF <br />REDWOOD CITY, a municipal corporation of the State of California ("City"); <br /> WITNESSETH: <br /> <br /> WHEREAS, pursuant to the provisions of Article VIII (commencing with § 14.115) <br />of Chapter 14 of the Code of the City of Redwood City (the "Ordinance") City provides <br />for the abatement of abandoned shopping carts; and <br /> <br /> WHEREAS, Participating Owner owns and operates a business within City's <br />corporate limits which provides shopping carts for the use of its customers; and <br /> WHEREAS, unauthorized removal of shopping carts from Participating Owner's <br /> business premises is detrimental to the efficient and economic operation of Participating <br /> Owner's business: and <br /> WHEREAS, shopping carts so removed are generally abandoned on public <br /> property; and <br /> WHEREAS, abandoned shopping carts are a public nuisance and are <br /> detrimental to the public health, safety, and welfare; and <br /> WHEREAS, City has entered into an agreement with a Shopping Cart Retrieval <br />Ser'vice (the "Contractor"); and <br /> <br />F:Atty2001Shared/Redwood/Council/Agmt/Agmt-519 1 <br /> <br /> <br />
