_ _W..:.. LL _
evaluate the cumulative effects of a preferred set of policies and programs on the
selected geographic sub-areas of the City. This analysis will focus on measuring the
cumulative economic, fiscal, and community benefit outcomes resulting from new
incentive-oriented land use regulations in the City to show more explicitly who
benefits and where the added development is likely to occur
The proposed program will include:
. Benefit priorities based by type and general location and the preferences
expressed during the community engagement process;
. Effective implementation strategies and procedural approaches;
• General Plan and Zoning Ordinance amendments that may be necessary to
implement the community benefits program; and
. Requirements for additional economic analysis.
Procedural alternatives may include:
. Development tiers, reflecting development intensity, project type, project
location;
. Ministerial approaches( e.g. as-of-right benefits with no discretionary review)
with prescribed benefits tied to specific bonuses;
. Adjudicative (Conditional Use Permit) discretionary review, which would allow
for reasonable conditions of approval; and
. Negotiated legislative authorization (development agreement, planned
development provisions, overlay districts, etc.).
The proposed program also will contain mechanisms for monitoring compliance and
outcomes. These may include periodic reviews to assess:
. Whether benefits provided meet expectations;
. Value of specific benefits in light of community needs, changes in regulatory
environment, other factors; and
. Effectiveness of administrative procedures and requirements.
4-B: Public-Private Defined Benefits Program Proposal for Adoption. Based on
feedback from the community and decision-makers on evaluation of altematives and
the preliminary proposed program, Consultant will prepare a Final Public-Private
Defined Benefits Program Proposal, which refines and details the components of a
regulatory strategy for the City to consider if it enacts regulations for "capturing
value" from new development to provide additional benefits to the community. The
outcome of this phase of work will include a proposed draft enabling ordinance for
the community benefits program, along with any needed General Plan'amendments.
The final program and supporting documents will include sufficient detail, so that
Staff will be able to use it as a basis for refining the draft ordinance in consultation
with the City Attorney and subsequently during the public review and adoption
process. Consultant also will describe the level of environmental review that wilf
likely be necessary depending on the potential effects of any required amendments
on the General Plan or Zoning Ordinance.
Products
ATTY/AGR/2014.091/DYETT&BHATIA
REV:06-05-14 VR Page 16 of 17
